Terms of Service — Punchless

1. Acceptance of Terms

By accessing or using Punchless (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Service Description

Punchless provides a digital loyalty/stamp card platform for local businesses. The Service allows businesses to create digital stamp cards, and allows customers to collect stamps and redeem rewards through a web browser without downloading an application.

3. Free Tier

The Free tier is available at no cost and includes unlimited stamp cards, full dashboard access, and the web scanner console. The Free tier displays a small sponsor banner on customer-facing stamp cards. Punchless reserves the right to modify the Free tier features at any time.

4. Pro Tier

The Pro tier (€15/month) removes the sponsor banner and provides additional features including custom domains, webhook APIs, and multiple staff/scanner accounts. The Pro tier is billed monthly and can be cancelled at any time. Refunds are not provided for partial billing periods.

5. Business Responsibilities

Business owners are responsible for the accuracy of their business information, the security of their account credentials, and compliance with applicable loyalty program regulations in their jurisdiction. Businesses must not misuse the Service to collect personal data from customers in ways that violate these terms or applicable law.

6. Customer Cards

Customer stamp cards are anonymous and device-bound. Punchless does not collect personal information from customers. Customers are responsible for the security of their device and passkey credentials. Lost devices or deleted cards cannot be recovered, similar to losing a physical paper stamp card.

7. Anti-Fraud

Punchless implements anti-fraud measures including daily stamp limits, server-signed QR tokens, and transaction logging. Businesses that attempt to circumvent these measures or abuse the Service may have their accounts suspended or terminated.

8. Termination

Either party may terminate their use of the Service at any time. Upon termination, all associated data will be permanently deleted from Punchless servers within 30 days.

9. Limitation of Liability

Punchless is provided "as is" without warranties of any kind. Punchless shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Service.

10. Changes to Terms

Punchless reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
